Terms and Conditions


Resolute To Change CIC was created to provide fun energised fitness and exercise activities for everyone in their homes, local parks, gyms and community centres.

Terms of Agreement

The Block Package, Monthly Package plan and the associated upfront lump sum or monthly direct debit, weekly/ monthly invoice(s), Monthly Package fees, initial minimum term and payment dates you have chosen are set out on this form (the initial minimum term is the first period of Block Package or Monthly Package). Our Block Package or Monthly Package is available with no initial minimum usage term.

Block Package or Monthly Package or Group Fitness sessions can be paid either upfront by lump sum or by weekly or monthly direct debit or PayPal and/ or other electronic invoice(s) which is agreed by the client and their Personal Trainer, which will be in the form of written (email, letter or mobile phone text message) confirmation, (we do not accept cash or card payment in person. All Personal Training Packages and Group Fitness Session purchases and payments must be completed through Resolute To Change CIC’s website, official Resolute To Change CIC's PayPal and authorised bank account linked directly to Resolute To Change CIC (https://www.resolutetochange.com) and not with any Personal Trainer working for or on the behalf of Resolute To Change. If you the client are unsure, please email info@resolutetochange.com to varify immediately.

If you choose to pay your Monthly Packages by the means of monthly Direct Debit, there will be an additional charge (1) which will mean the total amount payable for your membership will be greater than if you choose to pay as a lump sum upfront.

Your first direct debit or PayPal invoice payment will be collected in advance on the first or seventh working day of the month of joining and then reoccur monthly after that to ensure it falls on your first session joining date.

If you are paying by direct debit and you fall behind with your Monthly Package fees and this is not caused by a bank error, we may charge reasonable administration fees or suspend or cancel your Monthly Package; and we may pass your details to a debt-collection company to recover any outstanding payments.

We may decide to increase our Block Packages or Monthly Packages fees, but your fees will not increase in your initial minimum term of Block Packages or Monthly Packages (unless you do not provide ID and purchase receipts of your package). We will give you a minimum of 14 days ' notice of any fee change. If you pay your Block Packages or Monthly Packages fees upfront as a lump sum payment, we will only review your Block Packages or Monthly Packages fees when your Block Packages or Monthly Packages is due for renewal or before the time of your scheduled reoccurring weekly or monthly payment is due.

You can cancel your Block Packages or Monthly Packages or Group Fitness at any time if your circumstances change to such an extent that we are satisfied it is not possible for you to continue to use your Block Package or Monthly Package or Group Fitness (for example, due to medical reasons, if you are made redundant or if you move to an area which is more than 5 miles from where we deliver any of our Personal Training sessions). To cancel your Block Packages or Monthly Packages for medical reasons, you will need to give us notice (see term 14 below) and provide the documents we ask for as proof of the change in your circumstances by the end of the month to cancel your membership at the end of that same month. To cancel your Block Package or Monthly Package for non-medical reasons you must give us one full calendar months’ notice (see Block and Monthly Cancellation term below) and provide suitable proof of your change in circumstance.

During the initial Block Package or Monthly Package term, you must continue to pay your Block Package or Monthly Package fees in full or each month until you have provided evidence of your change in circumstance and we are satisfied with it. We will not be able to refund any fees you have paid upfront for a Block Package or Monthly Package period that has or has not yet passed once your cancellation has taken effect. You will be entitled to transfer any remaining or all your Block Package or Monthly Package to a nominated friend, family member or colleague of your choice. Your agreed nominated person will not be entitled to a full or partial refund on any transferred Block Package or Monthly Package, or Group Sessions or individual training sessions. You can also cancel your Block Package or Monthly Package if we seriously break these terms and conditions. We can cancel your Block Package or Monthly Package if: you have seriously broken the T&C’s and Member’s Health Pledge rules or any terms of this contract; you do not pay any fee or charge within seven days of the date it was due, and we have written to you and given you a further 14 days to pay (so the fee or charge is more than 21 days late); your Block Package or Monthly Package sessions will end (if this happens, we will not refund any Block Package or Monthly Package fees you have paid upfront that has not yet been completed); or for any other reason if we consider it necessary to end your contract.

You can cancel your Block Package 24 hours before your first session starts with your trainer, as this will be your cooling off period to ensure you are happy with your purchased package and decision. Please be advised that once your Block Package first session has started with your Personal Trainer (PT), we will not be able to offer you a full refund. We will be as flexible as we can by offering alternative solution such as; a different session date/ time/ location or transferring your Personal Training Package with a different PT for you to complete your Block Package, however this is not guaranteed. If this is not satisfactory to (the client) and all possible avenues have been explored i.e. transferring your Block Package to another PT, we will not be liable to process your refund.

If you pay your Monthly Package fees monthly by direct debit or PayPal or any other invoice method agreed by Resolute To Change CIC. You can cease your monthly rolling membership/ invoice at, or coincide with, the end of your initial minimum term. If you wish to renew into a new Monthly Package, we will contact you to discuss your options and you will continue for the same term and will be collected by direct debit or PayPal. If you wish to change your Personal Training Package plan or do not wish to renew, please give us one full calendar months’ notice. You must pay your full Monthly Package rate during your months’ notice. Example: You give the notice to end your Monthly Package contract on or any day after 1st April, but your full calendar months’ notice will not start until 1st May and you will leave on 31 May (your final payment, collected on the last working day of April, will be for the month of May).

You can request in writing (letter or email only) to freeze/ postpone/ delay or put on hold a minimum of one PT session or up to a maximum of twelve PT sessions or an equivalent of one weeks (seven calendar days) worth of PT sessions or an equivalent of five weeks (35 calendar days) worth of PT sessions that does not exceed more then a number of twelve sessions in total or 28 calendar days in total. The maximum length of time Resolute To Change CIC will hold all frozen/ postponed/ delayed or put on hold PT sessions will no be no longer than 28 calendar days from the first initial frozen/ postponed/ delayed or put on hold PT session request date and any or all additional frozen/ postponed/ delayed or put on hold PT session(s) that is requested after the first initiated PT session frozen/ postponed/ delayed or put on hold will be grouped and counted from the first frozen/ postponed/ delayed or put on hold PT session request and the 28 calendar days will not be restarted for any request after the first request unless the first 28 calendar days have lapsed. Any single or grouped frozen/ postponed/ delayed or put on hold PT session(s) not used which is more that Twelve (12) sessions or 28 calendar days and falls outside of the first confirmed request will not be entitled to a partial or full refund on or after the 28 calendar days has expired if all or partial PT sessions have not been used or is more than the Twelve (12) or 28 calendar days by (The Client or nominated transferred person).

You can ask to cancel your Monthly Package and give us notice by providing your Monthly Package details: in person; by calling 07848146839; or by completing the ‘contact us’ form on our website at https://resolutetochange.com/contact-us. We will send or give you a confirmation once we have processed your cancellation. This could be by email, or letter, depending on how you tell us you want to cancel your Monthly Package. Please tell us if you do not receive this. You are responsible for cancelling your direct debit or whatever method of payment you have in place. Once we have processed your cancellation and any payments relating to notice periods have been taken. We are entitled to keep any Block Package or Monthly Package fees we receive if you have not cancelled your direct debit instruction with your bank and you have not given us valid notice to cancel your Block Package or Monthly Package. If you pay your Block Package or Monthly Package weekly or by Direct Debit, you are contracted to continue all payment(s) until the full sum of your agreement has been contractedly met and completed.

If (the trainer) cancels or runs late. Unforeseen circumstances may arise which require our sessions to be rescheduled. In this event the following policy will apply: If (the trainer) are forced to cancel your session within 24 hours (the trainer) will make up the session at no charge to you. If (the trainer) are forced to cancel your session giving you more than 24 hours’ notice (the trainer) will reschedule as soon as possible. If (the trainer) runs late in starting your session, (the trainer) will extend the session time accordingly or make it up at a future date, whichever is most convenient to you.

If you (the client) cancel your session with less than 24 hours’ notice or fail to show you will be required to pay 100% of the session fee or have the session deducted from the overall agreed pre-paid session package amount.
If you (the client) cancel your session with the notice within 24 hours, then you will be required to pay 100% of the session fee or have the session be deducted from the overall Block Package or Monthly Package, or a possible reschedule of time or date at the discretion and availability of the trainer.
If you (the client) are late to a session, (the trainer) will do his/her best to get the most out of the remaining time left in the session, as (the trainer) are unable to run overtime due to previously arranged client commitments.

All information you give me will be kept in confidence and inline the government’s GDPR guidelines. Your personal details and medical information will not be made available to third parties unless permission to do so is granted by you verbally or written.

Customers purchasing any Personal Training Packages, Group Fitness and participating in the free Community Get Fit project must be 16 or older. You agree to provide when requested a recent photograph ID for your Client Agreement sign-up and to comply with ‘Member’s Health Pledge’, which is displayed online. We may change our ‘Member’s Health Pledge’ if this is reasonably necessary.

We may assign the benefit of this agreement and our rights thereunder to a third party on notice to you. Your rights under this agreement will not be prejudiced.

There may be occasions where we have to cancel all, or part of, the indoor and outdoor activities. In such circumstances, you will not be entitled to any partial or full refund. We will endeavour to advise you in advance where possible unless the issue is urgent or an emergency. Where possible we will try to ensure that any such cancellations are kept to a minimum. We will not be liable for or responsible for any failure to perform any of our obligations under this agreement which are caused by any event that is outside our reasonable control.

Please disclose all health information as requested at our initial consultation and keep (the trainer) updated and informed of any changes to your health status. This includes all medical conditions; physical and mental, injuries, allergies, and medication you are taking. If necessary, you (the client), may need to seek clearance from your doctor before participating in the exercise programme (the trainer) recommends.

Our staff, agents and subcontractors are not medically qualified so if you have any doubts about your fitness or capability to exercise, we strongly recommend that you get advice from a doctor first. If you have a medical condition that may affect your safety or wellbeing, we strongly advise you to obtain a letter from your GP permitted you to exercise, as you will not be able to join in any of our fitness classes and you will be not be refunded any or all of your Personal Training package or Group Fitness purchase if found you have not obtained your GP permission before your Personal Training or Group Fitness session starting. For safety reasons, you are responsible for correctly using all the Personal Training, Group Fitness and Community Get Fit equipment reading and agreeing to keep to the conditions in the ‘Member Health Pledge’, which is available online. We strongly advise that all new customers complete a health check and fitness consultation (https://resolutetochange.com/free-consultation-pt-taster-session) before starting your Personal Training, Group Fitness and Community Get Fit session and you should ask for one if we do not offer you one. If you are not sure how to use any equipment, always ask a member of staff.

The trainer will always use his/her judgment and experience to suggest certain exercises and other lifestyle advice that (the trainer) believes will help you achieve your personal goals, but if at any time you have specific requests please tell (the trainer), so (the trainer) can accommodate them.

All Resolute To Change CIC personal trainers intend to work with you within the scope of their knowledge and competencies as a qualified Personal Trainer. Therefore, when they (the trainer) believe it is in your best interests to see another health professional, you will be referred appropriately.

Whilst for most people exercise is hugely positive with many health benefits, there remains some risk that (the trainer) requires you (the client) to be aware of and for you (the client) to sign the informed consent and disclaimer that (the trainer) will provide.

Personal Trainers (PT) at Resolute To Change CIC are self-employed and any service they provide or any other third party provides is a contract between them and you. We will not be liable for, or responsible for any monies paid to a PT or other third party. PT and other third-party services are arranged directly with the trainer or third party and not with us. We can transfer all or any part of our rights or responsibilities under this contract to another organisation, but this will not affect your rights under the contract.

While (the trainer) can give you the tools and encouragement to reach your goals, ultimately you (the client) will need to assume responsibility for making the required changes. (The trainer) can best help you with this process if you keep (the trainer) fully informed of any issues that arise for you (the client), and if you have any questions or concerns whatsoever please don’t hesitate to voice them with (the trainer).

To get the most out of your session we recommend the following:

  • Have a small snack or light meal two or three hours before your session
  • Be sure you are well hydrated, avoid alcohol and smoking before training
  • Bring your hand sanitiser or antibacterial wipes to your session
  • If you are feeling unwell before your session, please contact (the trainer) or our team (https://resolutetochange.com/contact-us)
  • Bring a small towel and water bottle to your session
  • Wear appropriate clothing and footwear (ask the trainer if you are unsure)
  • Be ready at the appointed time
